Dr McBride - I need to send you information about the 5 enforcement actions I brought on behalf of five different whistleblower clients concerning EHR deficiencies. The first one led to a historic settlement in 2017 with the government by eClinjcalWorls for 155 million and a corporate integrity agreement intended to set the standard for EHR compliance. Massive problems remain but the series of cases led to some improvements. Now keeping an eye on AI and Clinical Decision Support tools embedded in EHRs where massive risk for corruption of decisionmaking process. There was a CBS episode made about one of our client’s cases and the patient death that had to occur tragically for us to get traction in enforcement. I will send you those materials. Helpful for people to know there can be enforcement efforts against the tech companies when their intersection with healthcare causes problems.
